Introduction

The following list was taken from Schedule I of the Freedom of Information Act 2000 as it appears on the Statute Law Database1. Certain changes to layout/format may be made (e.g we may remove full stops from the end of lines). As this is a wiki page we cannot guarantee it agrees exactly to the official version of Schedule I of the Act.

Part of the reason for this page is to make it easier for people to see which public authorities are subject to the Act but not yet on WhatDoTheyKnow.com so that more can be added.

The DCA used to keep an updated version of Schedule I, but the responsibilities of this department in regards to freedom of information were transferred to the Ministry of Justice.

The list has now been updated with all legislative amendments up to the end of 2009 (and a little beyond).

Entries highlighted in yellow (not on the main list) are those we don't have contact email addresses for. We rely on volunteer help for these, so please contact the WhatDoTheyKnow team with an email address for the authority & a URL for their homepage if you're able to help out.

Entries struck through are those that have been removed from Schedule I by a Statutory Instrument. Entries added or amended will have the relevant Act or Order appended after it in brackets, eg (added by SI2005/3593). There is still a significant of public authorities named in Part VI who are effectively defunct, but have not yet been formally removed from the Act - a note will be added below describing their status.

SCHEDULE 1

Public authorities

Part I - General

(a) information relating to any residential address of a member of either House of Parliament,
(b) information relating to travel arrangements of a member of either House of Parliament, where the arrangements relate to travel that has not yet been undertaken or is regular in nature,
(c) information relating to the identity of any person who delivers or has delivered goods, or provides or has provided services, to a member of either House of Parliament at any residence of the member,
(d) information relating to expenditure by a member of either House of Parliament on security arrangements.
Paragraph (b) does not except information relating to the total amount of expenditure incurred on regular travel during any month. (amended by SI 2008/1967)

Part III - The National Health Service

England and Wales

(a) in accordance with arrangements made under section 92 or 107 of the National Health Service Act 2006, or section 50 or 64 of the National Health Service (Wales) Act 2006; or
(b) under a contract under section 84, 100 or 117 of the National Health Service Act 2006 or section 42 or 57 of the National Health Service (Wales) Act 2006;
in respect of information relating to the provision of those services (added by Health and Social Care (Community Health and Standards) Act 2003, amended by Health Act 2006 to include ophthalmic services, and amended by National Health Service (Consequential Provisions) Act 2006 and Health Act 2006)
(a) a pilot scheme established under section 134 of the National Health Service Act 2006 or section 92 of the National Health Service (Wales) Act 2006; or
(b) an LPS scheme established under Schedule 12 to the National Health Service Act 2006 or Schedule 7 to the National Health Service (Wales) Act 2006,
in respect of information relating to the provision of those services (amended by National Health Service (Consequential Provisions) Act 2006)

Part IV - Maintained schools and other educational institutions

  • 52 - The governing body of—

  • (a) a controlled school, voluntary school or grant-maintained integrated school within the meaning of Article 2(2) of the Education and Libraries (Northern Ireland) Order 1986, or
  • (b) a pupil referral unit as defined by Article 87(1) of the Education (Northern Ireland) Order 1998.
  • (2) In sub-paragraph (1) “managers” has the meaning given by Article 2(2) of the Education and Libraries (Northern Ireland) Order 1986.
  • 55 - (1) The governing body of—
  • (a) a university receiving financial support under Article 30 of the Education and Libraries (Northern Ireland) Order 1993,
  • (b) a college of education in respect of which grants are paid under Article 66(2) or (3) of the Education and Libraries (Northern Ireland) Order 1986, or (amended by Colleges of Education (Northern Ireland) Order 2005)
  • (c) an institution of further education within the meaning of the Further Education (Northern Ireland) Order 1997.
  • (2) In sub-paragraph (1) “governing body” has the meaning given by Article 30(3) of the Education and Libraries (Northern Ireland) Order 1993.
  • 56 - Any person providing further education to whom grants, loans or other payments are made under Article 5(1)(b) of the Further Education (Northern Ireland) Order 1997.

Miscellaneous

(a) by virtue of any enactment has the function of nominating individuals who may be appointed as special constable by justices of the peace, and

Prospective changes

The following amendments to this schedule have appeared in primary legislation but not yet been brought into force:

Child Poverty Act 2010

Schedule 1, Paragraph 21:

21 In Part 6 of Schedule 1 to the Freedom of Information Act 2000 (other public bodies and offices: general) at the appropriate place insert—
“The Child Poverty Commission.”

Constitutional Reform and Governance Act 2010

Schedule 2, Paragraph 12:

12 In Part 6 of Schedule 1 for “The Civil Service Commissioners” substitute “The Civil Service Commission”.

Schedule 7 also makes other changes to the Act.
