Further Education College

FOIA Schedule 1 Part IV includes:
- 53 - (1) The governing body of—
- (a) an institution within the further education sector,
- (2) In sub-paragraph (1)—
- (a) “governing body” is to be interpreted in accordance with subsection (1) of section 90 of the Further and Higher Education Act 1992 but without regard to subsection (2) of that section,
- (b) in paragraph (a), the reference to an institution within the further education sector is to be construed in accordance with section 91(3) of the Further and Higher Education Act 1992,
The Further and Higher Education Act 1992 (as amended by the Apprenticeships, Skills, Children and Learning Act 2009) defines:
- 91.— (3) References to institutions within the further education sector are to—
- (a) institutions conducted by further education corporations, and
- (b) designated institutions for the purposes of Part I of this Act (defined in section 28(4) of this Act), and
- (c) sixth form colleges,
- and references to institutions outside the further education sector are to be read accordingly.
- (3A) References to sixth form colleges are to institutions conducted by sixth form college corporations.
Further education corporations are established under sections 15 and 16 of that Act, in either case by statutory instrument. They can also be created by conversion of a sixth form college corporation under section 33D. The governing body of an institution conducted by a further education corporation is the corporation itself. Relevant orders include SI 1992/2097, SI 1992/2315, SI 1993/97, SI 1993/269 and SI 1994/1449.
Designated institutions are those institutions designated by an order under section 28 of that Act. For these institutions, "governing body" means roughly what it says (but see s90 of the 1992 Act for details). Relevant orders include SI 1993/215, SI 1993/435, and SI 1993/562. Designated institutions can have their governing bodies incorporated by an order under under s143(4) Learning and Skills Act 2000. The only such order is SI 2001/1119.
Sixth form college corporations can be created by various mechanisms:
- By designation under s33A of an existing further education corporation or the incorporated governing body of a designated institution. This can only be done once, and has been done by SI 2010/624.
- By designation under s33B of either of the same categories of corporation.
- By establishment of a new body under s33C.
The governing body of a sixth form college is the corporation.
