- Summary: The complainant requested a copy of the options appraisal carried out by Greenwich Council (�the Council�) in its consideration of Hervey Road Sports Field as a potential site for the redevelopment of Willow Dene School. The Council initially claimed that the information was exempt under section 22 of the Act. In the event the information fell within Environmental Information Regulations (EIR), the public authority advised that regulation 12(4)(e) (internal communications) applied. The Commissioner is satisfied that the information requested is environmental information and should be considered under the EIR. The Commissioner found that under the EIR the exception at regulation 12(4)(e) was engaged in relation to the information withheld but the public interest in maintaining the exception did not outweigh the public interest in disclosure. The Commissioner orders Greenwich Council to disclose the information withheld under 12(4)(e).
