- Summary: The Commissioner’s decision in this matter is that the Department for Education and Skills (DfES) has partially failed to comply with its obligations under section 1(1) of the Freedom of Information Act 2000 (the Act). The Commissioner requires DfES to disclose the information previously withheld under section 35 of the Act but decided it had acted correctly in withholding information under section 42. This decision is currently under appeal to the Information Tribunal.
