The requests were refined and the Commissioner has made a decision about three outstanding items. The Commissioner has concluded that all of those items, in this context, constitute the complainant�s personal data and therefore they are exempt under section 40(1) and should have been considered under section 7 of the Data Protection Act 1998. He has found a breach of section 17(1)(b) in relation to the refusal notice provided in respect of one of the requests. He has not ordered any remedial steps.
