  • Summary: On the 3 October 2005 the complainant requested information in relation to action taken by the Department of Constitutional Affairs now the Ministry of Justice (‘MOJ’) regarding judicial misconduct. The Ministry of Justice initially refused the information but did not give the complainant a reason under the Freedom of information Act 2000 (‘the Act’). They later released some information requested by the complainant but refused the remainder under section 12 (1) of the Act. The Commissioner concluded that the Ministry of Justice has breached section 10 (1), section 17 (5) and section 17 (7) in relation to their handling of this case, but have correctly applied section 12 (1) to the remaining information.
