  • Summary: The complainant requested information about the circumstances surrounding the departure of a previous Chief Executive of the public authority. The public authority refused to disclose the information on the basis that it was personal data and disclosure would breach the Data Protection Act. The public authority also refused to disclose this information on the basis of section 41. The Commissioner has reviewed the requested information and has decided that the public authority correctly applied section 40 in this case. In view of this, the Commissioner did not consider the public authority’s application of section 41.
