The Cabinet Office refused to confirm or deny whether it held information falling within the scope of the request and cited the exemption provided by section 38(2) (health and safety). The Commissioner decided the Cabinet Office had breached section 1(1)(a) by failing to notify the complaint in writing whether it held information of the description specified in the request and now the Commissioner requires it to provide the complainant with that confirmation or denial.
