The Department for Business, Enterprise and Regulatory Reform (BERR) informed the complainant that aside from the information disclosed to him, no further documents are held relating to the drafting of the consultation document. BERR also refused to disclose the individuals name under section 40 of the Act. The Commissioner has investigated and finds that no further information is held regarding the consultation document and that BERR were correct in the application of section 40 to the individual’s name.
