- Summary: The complainant requested information from Trafford Metropolitan Borough Council (the Council) regarding the bids it had received when offering a property for sale by informal tender. The Council refused to supply the information on the grounds that to do so would prejudice its commercial interests and that therefore it was exempt under section 43 of the Act. The Council further stated that the public interest in maintaining the exemption outweighed the public interest in disclosure. The Commissioner has reviewed the Council�s decision and considers that it has failed to demonstrate how its commercial interests would be prejudiced by disclosing the information requested. The Commissioner therefore requires the Council to provide the withheld information to the complainant within 35 days of the date of this notice.
