The BBC stated that the requested information falls outside the scope of the Act because it is information relating complaints about programme content and is therefore held for the purposes of art, journalism or literature. The Commissioner’s decision is that the requested information relates to the journalistic and research process associated with programme content, and that the BBC correctly determined that the information is held to a significant extent for the purposes of art, journalism or literature. Therefore the BBC is not obliged to comply with Parts I to V of the Act.
