Decision Summary

  • Case Ref: FS50101920
  • Date: 25 July 2006
  • Public Authority: National Savings and Investments
  • Summary: The complainant requested information relating to premium bond prize draw winners, specifically the bank statements of winners which would demonstrate that the prize had been paid. The public authority initially failed to respond under the Act, but following the intervention of the Commissioner they did respond, invoking section 44. Section 44 exempts information which is subject to a statutory prohibition from disclosure, in this case the Premium Savings Bond Regulations 1972. The Commissioner is satisfied that section 44 is engaged and does not require any future action of the public authority, although it did breach the Act by failing to issue an adequate refusal notice. The Information Tribunal has ruled on this decision and has upheld this appeal.
