The public authority released information in respect of the majority of contractors but withheld the remainder citing sections 43(2) of the Act. As some concerns also related to health and safety issues the Commissioner has also considered the application of section 38, although this was not cited by the public authority. The Commissioner’s decision is that the exemptions at section 43(2) and 38(1) are not engaged. The complaint is therefore upheld and the Commissioner requires the information to be disclosed.
