  • Summary: The complainant requested figures for the number of speeding tickets issued at camera sites 265 and 266 on Marlow Road in High Wycombe. The public authority refused to provide this information citing section 31 (Law Enforcement Exemption) as the basis for its refusal. In correspondence with the Commissioner, the public authority also cited section 38 (Health and Safety Exemption) as an additional basis for its refusal. The Commissioner found that the public authority did not comply with some of its procedural obligations under the Act. However the Commissioner decided that the information was exempt because disclosure would prejudice law enforcement and would endanger health and safety and that the public interest in maintaining both exemptions outweighed the public interest in disclosing the requested information. The Information Tribunal has ruled on this decision and has upheld this appeal.
