The FSA refused to disclose certain information relying on section 44 of the Freedom of Information Act 2000 citing section 348 of the Financial Services and Markets Act 2000 (“FSMA”) as the relevant statutory bar. The Commissioner, after investigation and upon considering the relevant documents, finds that the FSA were correct in their application of the exemption.
