• Summary: The complainant was refused information about the application of the Department’s Coal Investment Aid scheme to the Aberpergwyn Colliery. The Commissioner decided that information contained within reports to the department from its consultants had been correctly withheld using the section 41 exemption but that the Department had been in breach of section 17 of the Act in not including section 41 in its refusal notice. He also decided that other information, about the offer of aid and employment at the mine, had been wrongly withheld as the section 43 exemption was not engaged.
