  • Summary: The complainant submitted five questions in which he requested information relating to the sale of Council properties to elected members, ex-elected members, officers and ex-officers of the Council since 1979. The Council initially refused the request on the basis that the cost of complying with each question individually would exceed the appropriate limit. During the Commissioner�s investigation, the Council determined that it would be able to provide part of the requested information within the appropriate limit. However, the Council withheld this information under section 40(2) of the Act. The Commissioner finds that the Council correctly applied section 12 of the Act to some of the questions. The Commissioner also finds that the Council correctly applied section 40(2) of the Act in respect of the withheld information. However, the Commissioner also finds that the Council breached section 16(1) and section 17(5) of the Act.
