  • Summary: The complainant requested information concerning an investigation into, and subsequent resignation of, a former Head of Communications at the Council. Although the Council released some information, it refused parts of the request under section 40(2) of the Act. The Commissioner considers the Council is correct to withhold this information under section 40(2) and has therefore decided not to uphold the complaint. However, the Commissioner has found that the Council breached sections 17(1) of the Act but does not require the Council to take any action.
