  • Summary: The complainant requested a considerable volume of information about the process and amounts paid in bonuses to members of staff in the public authority. The public authority provided the basic information and the total annual amounts paid; but claimed that the individual posts that received bonuses and the amounts paid to individual Senior Post Holders were exempt from disclosure. The complainant complained to the Commissioner about the public authority’s failure to provide information for these two parts of his request. After the Commissioner began investigating this case, it was established that the public authority was relying on section 40(2) of the Act to exempt the requested information from disclosure. The Commissioner found that there were procedural breaches of sections 10(1), 17(1), 17(1)(b) and 17(7) of the Act. However the Commissioner has determined that the public authority was correct in applying section 40(2) in relation to both parts of the request he was investigating. The Commissioner requires no remedial steps to be taken in this case.
