The public authority refused the request, citing section 41 of the Act (information provided in confidence). During the course of the investigation the complainant stated that he wanted the names of the individuals who had made the complaints and was no longer interested in receiving the details of those complaints. The Commissioner’s decision is that the public authority applied the Act appropriately in withholding the names by virtue of section 41 of the Act. Furthermore, the Commissioner considers that the names of the individuals could have been withheld by virtue of the section 40 exemption (personal information).
