The Commissioner is satisfied that, under section 12 of the Act, the public authority was not obliged to confirm or deny whether it held the information, as to do so would in itself exceed the appropriate limit. The public authority informed the complainant within 20 working days of the request that it was relying on section 12 of the Act, and the Commissioner is therefore satisfied that the public authority has complied with section 17 of the Act. Following the Commissioner�s intervention, the public authority provided further advice and assistance to the complainant and the Commissioner now considers that the public authority has complied with section 16 of the Act. An appeal was made to the Tribunal but later withdrawn.
