  • Summary: The complainant requested copies of agendas, minutes and papers submitted to the Falklands �War Cabinet�. The Cabinet Office confirmed that it held the information requested but argued that it was exempt under section 35(1)(a) and (b) of the Act. The Cabinet Office later also sought to rely on the exemptions at sections 26(1)(a) and (b), 27(1)(a), (c) and (d), 35(1)(c) and 42(1) of the Act. The Commissioner found that some of the requested information was not in fact held, and that the Cabinet Office correctly withheld the remainder of the information in reliance on the exemptions at sections 26(1)(a), 26(1)(b), 27(1)(a), 27(1)(c), 27(1)(d), 35(1)(b), 35(1)(c) and 42(1) of the Act. Therefore the Commissioner requires no further steps to be taken.
