- Summary: The complainant requested a breakdown of the average viewing figures of every BBC Wales generated programme during 2004. The BBC refused to disclose the requested information on the basis that it was held for the purposes of journalism, art or literature. The Commissioner disagrees with this position finding that the requested information is held for purposes other than journalism, art and literature. However he has considered whether the information is exempt from disclosure for other reasons and finds that section 43 of the Act is engaged and that the public interest favours maintaining the exemption from disclosure.
