  • Summary: On 17 March 2005 the complainant requested information related to a matter discussed at a meeting of the Strategy and Resources Overview and Scrutiny Committee. The council provided some information but withheld over a series of letters dated between 19 April 2005 and 28 July 2005, citing section 40 (personal information). The Commissioner considered allegations of breach of time limit, failure to provide a refusal notice that complied with the Act, failure to give advice and assistance and incorrect application of the personal data exemption. Having investigated, the Commissioner requires the council to release certain information withheld under section 40 exemption. The Information Tribunal has ruled on this decision and has partly upheld this appeal.
