• Summary: The Complainant requested a section of an internal audit report of a contract between the council and a private company for the purposes of highway maintenance. The council refused the request claiming that it engaged the exemptions of the Act in section 43 (commercial prejudice) and section 36 (prejudice to the effective conduct of public affairs). The Commissioner's decision is that section 43 does not apply to the information. He has also decided that although section 36 is applicable, the public interest in maintaining the exemption does not outweigh the public interest in disclosing the information.
