  • Summary: The complainant requested information from the Police Service of Northern Ireland (the ‘PSNI’) relating to its policy on shotgun licensing. The PSNI released some information to the complainant, and released further information both before and after the Commissioner’s intervention. However, the Commissioner was concerned that the PSNI had incorrectly applied the exemption under section 38 (health and safety) to some of the information, and had not conducted an adequate public interest test. The Commissioner found that the PSNI had correctly applied the exemption under section 40(2) of the Act to some personal information identifying junior staff, but that the PSNI should release personal information identifying more senior staff. In addition the Commissioner found that the PSNI failed to respond within the statutory time limit, and failed to conduct an internal review. The Commissioner requires the PSNI to release some of the withheld information to the complainant.
