  • Summary: The complainant requested names of probation officers involved in the care of a prisoner released on licence, and also details of any actions taken against them. While out of prison the prisoner stole a motor vehicle and a police officer was killed in the ensuing pursuit. The Home Office confirmed no action was taken against the probation officers but refused to provide their names, arguing that the information was exempt under section 40 (Personal Data) and section 36 (Prejudice to the Effective Conduct of Public Affairs). The Commissioner's decision is that the information was personal data and that disclosure would breach the first data protection principle. As the Commissioner decided that the information was exempt under section 40 of the FOI Act which is an absolute exemption he did not review the public interest test in respect of section 36.
